HEARING FOR MINOR SUBDIVISION NUMBER MS 20-015 DUANE AND MARY MARSON FOREBAY FARMS, LLC.

ALL RIGHT, AWESOME THIS IS ON, PERFECT.

ALL RIGHT, GOOD MORNING, MR. CHAIR. MEMBERS OF THE COMMISSION.

TODAY I WILL BE PRESENTING MINOR SUBDIVISION MS 20-015 FOR DUANE AND MARY MARSON AND FOREBAY FARMS. THE REQUEST IS TO CREATE A FOUR ACRE HOMESITE PARCEL FROM AN EXISTING EIGHTEEN POINT THREE ACRE PARCEL AND COMBINE THE REMAINING ACREAGE WITH ABUTTING PARCEL.

THE PROJECT SITES LOCATED IN THE SOUTHEAST CORNER OF GRIFFITH AVENUE AND AUGUST ROAD AND IS DESIGNATED AGRICULTURAL LAND USE AND ZONED A1.

HERE WE HAVE THE VICINITY OF THE PROJECT SITE.

THE PROJECT SITE AND SURROUNDING AREA IS CHARACTERIZED BY AGRICULTURAL OPERATIONS AND OCCASIONAL RESIDENCES AN IRRIGATION CANAL RUNS THROUGH THE SITE TO THE NORTH.

HERE WE HAVE A CLOSER AERIAL IMAGE OF THE PROJECT SITE.

SO THE HOMESITE PARCEL WILL CONSIST OF THE EXISTING SINGLE FAMILY RESIDENCE IDENTIFIED WITH THE BLUE ARROW ON THE SLIDE, OR THE ABUTTING PARCEL WILL ABSORB THE REMAINING ACREAGE. AGRICULTURAL USES FOR THE COMBINED PARCEL WILL REMAIN UNCHANGED.

HERE WE HAVE THE TENTATIVE MAP FOR THE SUBDIVISION WITH THE PROPOSED HOME SITE OUTLINED IN BLUE AND THE PROPOSED REMAINDER OUTLINED IN ORANGE.

THE 200 FOOT AGRICULTURAL SETBACK REQUIREMENT OF THE ZONING CODE IS INDICATED WHERE NECESSARY, SPECIFICALLY TO THE NORTH, SOUTH AND EAST OF THE EXISTING RESIDENTS ON THE HOMESITE PARCEL. HERE WE HAVE AN IMAGE OF THE PROJECT SITE, SPECIFICALLY THE REMAINDER TAKEN FROM THE CORNER OF GRIFFITH AVENUE AND AUGUST ROAD.

HERE WE HAVE AN IMAGE OF THE HOMESITE PARCEL WITH THE EXISTING DWELLING ON THE LEFT AND ACCESSORY STRUCTURE ON THE RIGHT.

THE PROJECT HAS BEEN FOUND CONSISTENT WITH THE GENERAL PLAN, GOALS AND POLICIES REGARDING AGRICULTURAL LEASE ON PARCELS, AND IT CONSISTENT WITH PROVISIONS OF THE SUBDIVISION MAP ACT AND TITLE 17.

THE PROJECT IS ALSO CONSISTENT WITH APPLICABLE ZONING CODE REQUIREMENTS, SPECIFICALLY THOSE RELATED TO THE AGRICULTURAL SETBACK AND MINIMUM PARCEL SIZE.

STAFF HAS FOUND THAT NO FURTHER ENVIRONMENTAL REVIEW IS REQUIRED PURSUANT TO SECTION ONE FIVE ONE SIX TWO SUBSEQUENT EIRS AND NEGATIVE DECLARATIONS OF THE CEQA GUIDELINES.

THE ANALYSIS THAT HELPED MAKE THESE FINDINGS CAN BE FOUND IN THE CEQA FINDINGS AND ANALYSIS PROVIDED AS AN ATTACHMENT TO THE STAFF REPORT.

SO NOTICE TO THE PUBLIC HEARING WAS MAILED TO PROPERTY OWNERS WITHIN 300 FEET OF THE PROJECT SITE ON OCTOBER 23RD AND PUBLISHED IN THE SUNSTAR ON THE SAME DATE.

TO DATE, NO COMMENTS HAVE BEEN RECEIVED.

WITH THAT STAFF HAS TWO RECOMMENDATIONS FOR THE COMMISSION TODAY.

MOTION TO DETERMINE AND NO FURTHER ENVIRONMENTAL REVIEW IS REQUIRED AND MOTION TO APPROVE MINOR SUBDIVISION NUMBER MS 20-015.

THAT NOW CONCLUDES MY PRESENTATION AND I'M AVAILABLE TO ANSWER ANY QUESTIONS.

OK, I'LL MOVE ON THE CEQA THAT THE PLANNING COMMISSION DETERMINED NO FURTHER ENVIRONMENTAL REVIEW IS REQUIRED PURSUANT TO SECTION 15162 SUBSEQUENT EIRS AND NEGATIVE DECLARATIONS OF THE CEQA GUIDELINES BASED ON THE ANALYSIS AND THE 20 30 MERCED COUNTY GENERAL PLAN PROGRAM, ENVIRONMENTAL IMPACT REPORT AND THE ATTACHED CEQA SECTION FIFTEEN ONE SIXTY TWO FINDINGS AND ANALYSIS.

JUST REAL QUICK, MR. CHAIRMAN WOULD LIKE TO ACKNOWLEDGE KRISTEN MCKINNEY ACTUALLY HAS REJOINED US. WE LOANED HER TO THE PUBLIC HEALTH ORGANIZATION DUE TO THE COVID CRISIS WHERE SHE WAS TEMPORARILY REASSIGNED OVER THERE DID A NICE JOB SHE CAME BACK TO TO WORK WITHIN THE ORGANIZATION HERE ON MONDAY.

WE ARE CERTAINLY PLEASED TO SEE HER BACK AND WANTED TO JUST SAY THANK YOU, KRISTEN FOR YOUR WILLINGNESS TO TO HELP OUT THE COUNTY.
