THE REQUEST IS TO EXTEND THE EXPIRATION DATE OF THE APPROVED TENTATIVE MAP BY ONE YEAR SO THAT IT WOULD EXPIRE IN TWENTY TWENTY ONE.

THE MAP WAS ORIGINALLY APPROVED BY THE PLANNING COMMISSION ON JULY 13TH, TWO THOUSAND FIVE TO SUBDIVIDE THREE HUNDRED AND TWELVE LOTS INTO APPROXIMATELY EIGHT THOUSAND ONE HUNDRED RESIDENTIAL LOTS.

FOR THE RECORD, EVEN THOUGH THE APPROVAL WAS FOUR THOUSAND ONE HUNDRED AND SIXTY TWO LOTS, THE ACTUAL TEN' MAP IS ONLY ABOUT NINE HUNDRED AND THIRTY TWO LOTS.

FOR SOME REASON THEY HAD INCLUDED PHASE ONE, WHICH WAS ALSO APPROVED IN TWO THOUSAND THREE FOUR AS MAJOR SUBDIVISION MAS ZERO THREE DASH ZERO ONE ZERO.

SO AGAIN, FOR THE RECORD, THE ACTUAL TENTATIVE MAP INCLUDES ABOUT NINE HUNDRED LOTS, UH, THIS TEN' MAP HAS BEEN EXTENDED MULTIPLE TIMES, FOUR TIMES BY THE PLANNING COMMISSION AND FIVE TIMES BY THE STATE.

IT ALSO IS BEING CONSIDERED AS PART OF A DEVELOPMENT AGREEMENT THAT THE PLANNING COMMISSION HAD RECOMMENDED THE BOARD APPROVE ON JULY 8TH.

SO THE PURPOSE OF THIS EXTENSION APPLICATION IS TO ENSURE THAT THE MAP WILL NOT EXPIRE BEFORE THE BOARD OF SUPERVISORS CONSIDER THE DEVELOPMENT AGREEMENT, ALSO KNOWN AS DA19-001 ON JULY TWENTY EIGHT TWO TWENTY TWENTY.

THE PROJECT SITE HIGHLIGHTED HERE IN RED, IS LOCATED ON THE EAST SIDE OF HIGHWAY THIRTY THREE ON THE NORTH AND SOUTH SIDE OF PARKWAY BOULEVARD.

IT'S LOCATED WITHIN THE SANTA NELLA COMMUNITY SPECIFIC PLAN, ALTHOUGH THE IMMEDIATE SURROUNDING AREA IS MOSTLY UNDEVELOPED.

UH, MOST OF THE DEVELOPED PORTION OF THE SANTA NELLA COMMUNITY SPECIFIC PLAN IS LOCATED NORTHWEST. HERE IS THE APPROVED TENTATIVE MAP.

AS YOU CAN SEE, THE HOLLOWED OUT AREA OF THIS MAP SHOWS PHASE ONE AND THEN THE REST OF THE ACTUAL SUBDIVIDED LOTS ARE PHASE TWO.

UH, THE PROJECT SITE IS DESIGNATED LOW DENSITY RESIDENTIAL LAND USE AND ZONED R1 FIVE THOUSAND SINGLE FAMILY RESIDENTIAL.

BECAUSE THERE'S NO CHANGE TO THE PROJECT PROJECT SITE, THE SURROUNDING AREA, THE PROJECT CAN BE FOUND CONSISTENT AGAIN WITH THE GOALS AND POLICIES OF THE GENERAL PLAN.

THE SANTA NELLA COMMUNITY SECIFIC PLAN AS WELL AS APPLICABLE PROVISIONS OF THE ZONING CODE SUBDIVISION MAP ACT AND TITLE SEVENTEEN OF THE COUNTY CODE.

UH, STAFF HAS DETERMINED THAT THERE IS NO FURTHER ENVIRONMENTAL REVIEW REQUIRED TO PURSUANT TO SECTION ONE FIVE ONE EIGHT TWO RESIDENTIAL PROJECTS PURSUANT TO A SPECIFIC PLAN. THIS IS BECAUSE THE PROJECT SCOPE WAS WITHIN THE SANTA NELLA COMMITTEE SPECIFIC PLAN AND WAS ANALYZED AS PART OF EIR THAT WAS PREPARED FOR THE SPECIFIC PLAN AND CERTIFIED MARCH TWENTY SEVENTH, TWO THOUSAND AND ONE BY THE BOARD OF SUPERVISORS BECAUSE THERE HAVE BEEN NO CHANGES TO THE PROJECT PROJECT SITE OR THE ENVIRONMENTAL CHARACTER THE SURROUNDING AREA. AGAIN, THERE IS NO FURTHER ENVIRONMENTAL REVIEW REQUIRED.

NOTICE OF THIS PUBLIC HEARING WAS PUBLISHED IN THE MERCED SUN-STAR AND MAILED TO PROPERTY

FIRST, THAT THE COMMISSION DETERMINED THAT NO FURTHER ENVIRONMENTAL REVIEW IS REQUIRED, AND SECOND, THAT THE COMMISSION APPROVE EXTENSION APPLICATION NO.

THE PROJECT SITE IS DESIGNATED DELHI URBAN COMMUNITY MIXED USE LAND USE AND ZONED C2 GENERAL COMMERCIAL. BEFORE WE MOVE FORWARD IN THE PRESENTATION, I WOULD LIKE TO NOTE THAT A REVISION TO THE CONDITIONS OF APPROVAL THAT YOU RECEIVED IN YOUR PACKET HAS BEEN MADE.

CONDITION NUMBER SIX WHICH JUST CLARIFIED TO SPECIFY THAT SCREENING WILL ONLY BE REQUIRED FOR STORAGE OF VEHICLES OVERNIGHT.

SO JUST WANTED TO CLARIFY THAT THOSE AREAS ARE WHAT WILL BE REQUIRED TO BE SCREENED HERE.

HERE WE HAVE A SITE PLAN FOR THE PROJECT.

ALL FEATURES OF THE SITE ARE EXISTING, INCLUDING THE EXISTING SHOP AREA, RESTROOMS, OFFICE AND PARKING SPACES AS WELL.

HERE WE HAVE AN IMAGE OF THE PROJECT SITE, WHICH SHOWS THE EXISTING BUILDING AND SITE.

NO CHANGES, AS I MENTIONED, TO THE STRUCTURE PROPOSED.

HERE WE HAVE AN IMAGE OF AUTO PARTS STORE ACROSS THE STREET FROM THE PROJECT SITE.

AND HERE WE HAVE AN IMAGE OF AN EXISTING RESIDENCE LOCATED DIRECTLY WEST OF THE PROJECT SITE ACROSS LETTEAU AVENUE, AND I JUST WANTED TO NOTE WITH THESE IMAGES THAT IT SHOWS THAT IN THAT AREA THERE'S A MIX OF COMMERCIAL, RESIDENTIAL AND A VARIETY OF OTHER LAND USES IN THE PROJECT VICINITY.

THE PROPOSED TIRE SHOP IS CONSISTENT WITH THE GOALS AND POLICIES OF THE GENERAL PLAN RELATED TO URBAN DEVELOPMENT.

THE PROPOSALS ALSO CONSISTENT WITH THE GOALS OF THE MIXED USE DESIGNATION AND APPLICABLE PROVISIONS OF THE DELHI COMMUNITY PLAN.

AS A CONDITION, THE PROJECT IS ALSO CONSISTENT WITH THE ZONING CODE.

STAFF HAS FOUND THAT NO FURTHER ENVIRONMENTAL REVIEW IS REQUIRED PURSUANT TO SECTION ONE FIVE THREE ZERO ONE EXISTING FACILITIES OF CEQA GUIDELINES AND THE ANALYSIS TO HELP MAKE THIS DETERMINATION CAN BE FOUND IN THE STAFF REPORT.

NOTICE OF PUBLIC HEARING WAS MAILED TO ALL PROPERTY OWNERS WITHIN 300 FEET OF THE PROJECT SITE, ON JULY 10, 2020 AND PUBLISHED IN THE SUN-STAR ON THAT SAME DATE.

WITH THAT STAFF HAS TWO RECOMMENDATIONS THAT THE PLANNING COMMISSION DETERMINE THE PROJECT'S EXEMPT FROM ENVIRONMENTAL REVIEW AND THAT THE COMMISSION ALSO APPROVED

I WILL BE PRESENTING THIS PROJECT FOR OUR STAFF PLANNER, WASN'T ABLE TO ATTEND TODAY'S MEETING.

THIS PROPOSED PROJECT IS CUP16-001 FOR THE NUNES DAIRY.

THE APPLICANT IS ANTONIO NUNES.

THE REQUEST IS TO EXPAND THE EXISTING DAIRY FROM ONE THOUSAND TWO HUNDRED AND SEVENTY SIX ANIMALS. I'M SORRY, GET USED TO THIS FROM ONE THOUSAND TWO HUNDRED SEVENTY SIX ANIMALS TO TWENTY ONE HUNDRED ANIMALS.

THERE ARE CURRENTLY SEVEN HUNDRED AND SEVENTY SIX MILK AND DRY COWS, FOUR HUNDRED TWENTY EIGHT HEIFERS AND SEVENTY TWO COWS ON THE DAIRY FACILITY.

NOW THE PROPOSAL WILL EXPAND THE NUMBERS FROM OR TO EIGHTEEN HUNDRED MILK AND DRY COWS AS WELL AS THREE HUNDRED CALVES WITH THE HEIFERS BEING RELOCATED OFF SITE.

THIS REPRESENTS AN INCREASE OF EIGHT HUNDRED AND TWENTY FOUR ANIMALS ON THE SITE.

THERE ARE APPROXIMATELY EIGHTEEN ACRES OF ACTIVE DAIRY FACILITIES AND APPROXIMATELY ONE HUNDRED EIGHTY NINE ACRES OF FARMLAND FOR CROPS AS WELL AS APPLICATION.

AS PART OF THIS REQUEST, THE EXPANSION ALSO INCLUDES THE DEMOLITION OF A FORTY ONE THOUSAND TWO HUNDRED SQUARE FOOT ANIMAL SHELTER, AS WELL AS THE CONSTRUCTION OF A NEW EIGHTY FIVE THOUSAND EIGHT HUNDRED SQUARE FOOT FREESTYLE BARN WITHIN THE EXISTING DAIRY FOOTPRINT. TAKING A LOOK AT THE VICINITY OF THE PROJECT SITE, THE PROJECT SITE IS LOCATED ON THE NORTHEAST CORNER OF RYLEY ROAD AND THE PROJECT SITE CONSISTS OF FOUR PARCELS IDENTIFIED HERE IN RED, AGAIN TOTALING APPROXIMATELY TWO HUNDRED SEVEN ACRES.

THE DAIRY FACILITIES ARE LOCATED ON EIGHTEEN ACRES OF THE PROJECT SITE.

SO TAKING A LOOK AT THE AERIAL WE HAVE HERE, WE CAN SEE THE EXISTING DAIRY FACILITY WITH THE FREESTYLE BARN TO THE SOUTH.

WE'VE GOT SOME WASTEWATER LAGOONS, A MILK PARLOR, COMMODITY BARN AND SOME SINGLE FAMILY RESIDENCES TO THE WEST AND THE NORTHWEST OF THE PROJECT SITE.

LOOKING AT THE SITE PLAN, THE AREAS THAT ARE SHOWED HATCHED ARE THE PROPOSED AREAS TO BE DEMOLISHED WITH THE NEW FREESTYLE BARN SHADED IN BLUE IN THE MIDDLE OF THE DAIRY FACILITY. A COUPLE OF PHOTOS FOR YOU OF THE PROJECT SITE AND SURROUNDING AREA.

THIS PHOTO WAS TAKEN ON WE CAN SEE SOME OF THE ACTIVE DAIRY FACILITY.

THIS PHOTO WAS TAKEN ON HERE, WE CAN SEE THE EXISTING FREESTYLE BARN.

AND THEN THIS FINAL PHOTO WAS TAKEN AT THE RILEY RD.

EXTENSION, LOOKING DIRECTLY NORTH AGAIN, WE CAN SEE THE EXISTING FREESTYLE BARN TO THE RIGHT AS WELL AS APPLICATION FIELDS.

IN TERMS OF THE OPERATIONS, THIS PROPOSED PROJECT'S EXPANSION WILL INCREASE THE NUMBER OF EMPLOYEES FROM SEVEN TO NINE.

IT WILL ALSO INCREASE THE NUMBER OF DAILY VEHICLE TRIPS FROM TWENTY ONE TO APPROXIMATELY THIRTY ONE, INCLUDING FIVE TRUCK TRIPS.

THERE'S NO CHANGE TO THE WASTE MANAGEMENT SYSTEM ON THE SITE.

THIS INCLUDES FLESH AND SCRAPE SYSTEMS, WASTEWATER BEING APPLIED TO LAND APPLICATION AREA, AS WELL AS SOLID MANURE BEING REMOVED AND EXPORTED TO THE LAND APPLICATION AREAS.

IN TERMS OF CONSISTENCY WITH THE GENERAL PLAN, THE GENERAL PLAN DESIGNATION IS AGRICULTURAL STAFF HAS REVIEWED THE PROPOSAL FOR CONSISTENCY WITH THE GENERAL PLAN AND HAS FOUND THE PROJECT TO BE CONSISTENT WITH LOCAL CODES AND REGULATIONS, INCLUDING THE LAND USE, AGRICULTURAL, TRANSPORTATION AND CIRCULATION ELEMENTS, AS WELL AS THE NATURAL RESOURCES AND THE HEALTH AND SAFETY ELEMENTS WITH MITIGATION PROJECT CAN BE FOUND CONSISTENT WITH OR EXCUSE ME, THE AIR QUALITY WATER ELEMENT AND RECREATION AND CULTURAL RESOURCES ELEMENTS CAN BE FOUND CONSISTENT WITH THE GENERAL PLAN AS WELL.

THE PROJECT SITE IS ZONED A1 GENERAL AGRICULTURAL.

THE PROJECT CAN BE FOUND CONSISTENT WITH ALL APPLICABLE PROVISIONS OF THE ZONING CODE, INCLUDING THE ANIMAL CONFINEMENT ORDINANCE DESCRIBED IN CHAPTER EIGHTEEN POINT SIX FOUR OF OUR ZONING CODE. WITH REGARDS TO CEQA AN IS/MND WAS PREPARED FOR THE PROJECT PURSUANT TO SECTION ONE FIVE ZERO SEVEN ZERO DECISION TO PREPARE A NEGATIVE OR MITIGATED NEGATIVE DECLARATION OF THE CEQA GUIDELINES, 30 DAY PUBLIC REVIEW PERIOD BETWEEN JUNE 9TH, 2020 TO JULY 10TH, TWENTY TWENTY.

AS OF TODAY, NO COMMENTS WERE RECEIVED REGARDING THE ENVIRONMENTAL DOCUMENT.

IN ADDITION THE IS/MSD IDENTIFIED NINE MITIGATION MEASURES: THREE FOR AIR QUALITY, ONE FOR CULTURAL RESOURCES, ONE FOR HAZARD AND HAZARDOUS MATERIALS, THREE FOR HYDROLOGY AND WATER QUALITY, AND ONE FOR LAND USE COMPATIBILITY.

WITH THIS INFORMATION STAFF HAS TWO DETERMINATIONS FOR THE COMMISSION THIS MORNING.

THE FIRST IS TO DETERMINE THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT EFFECT ON THE ENVIRONMENT AND ADOPT THE PROPOSED IS/MND AND MMRP PURSUANT TO SECTION ONE FIVE ZERO SEVEN ZERO. AND THE SECOND IS TO APPROVE THE PROJECT CONDITIONAL USE PERMANENT NUMBER SIXTEEN DESK ZERO ZERO ONE, BASED ON THE FINDINGS IN STAFF REPORT AND SUBJECT TO THE RECOMMENDED CONDITIONS OF APPROVAL.
