MY NAME IS TIFFANY HO AND I'M WITH PLANNING AND I AM THE PROJECT PLANNER FOR DEVELOPMENT AGREEMENT NO. DA19-001 FOR THE APPLICANTS, AKT SANTA NELLA INVESTORS LLC AND RCI-SN PARKWAY 348, LLC.

THE PROPOSAL INVOLVES THE COMMISSION ADOPTING A RESOLUTION RECOMMENDING THAT THE BOARD OF SUPERVISORS ADOPT AN ORDINANCE APPROVING THE DEVELOPMENT AGREEMENT FOR APPLICANTS, AKT SANTA NELLA INVESTORS LLC AND RCI-SN PARKWAY 348, LLC. THIS DEVELOPMENT AGREEMENT WOULD CREATE VESTED RIGHTS FOR PROJECT APPROVALS AND ADDRESS IMPLEMENTATION OF THE PROPOSED PROJECT AND ASSOCIATED INFRASTRUCTURE IMPROVEMENTS IN THE AREA AND SPECIFY COUNTY BENEFITS. THE PROJECT SITE HIGHLIGHTED HERE IN RED INVOLVES ONE THOUSAND EIGHT HUNDRED LOTS.

LOCATED BETWEEN HIGHWAY 33 AND HILLSDALE AVENUE, BOUNDED BY THE CALIFORNIA AQUEDUCT AND INCLUDING APPROXIMATELY POINT TWO MILES OF LAND NORTH OF THE DELTA MENDOTA CANAL.

THE PROJECT SITE IS LOCATED IN THE SANTA NELLA COMMUNITY SPECIFIC PLAN AREA.

BUT MOST OF THE AREA, AS YOU CAN SEE IN THIS VICINITY, IS MOSTLY UNDEVELOPED.

MOST OF THE DEVELOPED AREA IS LOCATED NORTHWEST OF THE PROJECT SITE.

HERE IS AN AERIAL OF THE PROJECT SITE GENERALLY HIGHLIGHTED IN RED HERE.

AGAIN, YOU CAN SEE THAT IS UNDEVELOPED AND THE SURROUNDING AREA IS ALSO UNDEVELOPED.

THE FOUR BAY RECREATION AREA IS WEST OF THE PROJECT SITE.

THE PROPOSAL INCLUDES THREE APPROVED TENTATIVE MAPS, INCLUDING A MAJOR SUBDIVISION 310, ALSO KNOWN AS PARKWAY, WHICH WAS APPROVED BY THE COMMISSION ON SEPTEMBER 10TH, 2003, TO SUBDIVIDE ABOUT 60 ACRES INTO TWO HUNDRED THIRTY TWO LOTS.

ALSO MAJOR SUBDIVISION 03-15, WHICH IS PARKWAY PHASE TWO, WHICH WAS APPROVED ON JULY 13TH, 2005, TO SUBDIVIDE THREE HUNDRED AND TWELVE ACRES INTO ABOUT APPROXIMATELY 1100 LOTS, AS WELL AS SOME TRAILS, TWO PARKS AND A TWO ACRE COMMERCIAL SITE.

AND FINALLY, MAJOR SUBDIVISION 05-12, WHICH IS PARKWAY PHASE THREE, WHICH IS TO SUBDIVIDE 146 ACRES INTO 442 LOTS APPROVED IN NOVEMBER 16TH OF 2005.

THESE MAPS HAVE BEEN EXTENDED NUMEROUS TIMES BY THE STATE AS WELL AS THE COMMISSION.

MAJOR SUBDIVISIONS, 03-15 AND 05-12 HAVE TWO EXTENSIONS LEFT THAT CAN BE GRANTED BY THE

PLANNING COMMISSION, WHEREAS THE FIRST PHASE PARKWAY HAS EXPENDED ALL OF ITS DISCRETIONARY EXTENSIONS.

SO WITHOUT THIS DEVELOPMENT AGREEMENT, IT WOULD EXPIRE SEPTEMBER 10TH, 2020.

TO REITERATE, THE DEVELOPMENT AGREEMENT WOULD CREATE VESTED RIGHTS IN THE PROJECT APPROVALS FOR THE INITIAL PERIOD OF TWO YEARS AND THEN ALSO ADDRESS PROPOSED PROJECT AND ASSOCIATED INFRASTRUCTURE AGREEMENTS.

THE DEVELOPMENT AGREEMENT ALSO OUTLINES CERTAIN MILESTONES THAT THE APPLICANTS CAN MEET.

AND THEN FURTHER EXTEND THE DEVELOPMENT AGREEMENT AS WELL AS THE EXPIRATION DATES OF THESE MAPS. THE FIRST TERM EXTENSION CRITERIA, WHICH WOULD GRANT TWO YEARS, WOULD BE TO ENTER A WATER SUPPLY AGREEMENT WITH SANTA NELLA COUNTY WATER DISTRICT TO SUPPLY AT LEAST 50 PERCENT OF BUILD-OUT OF THE THREE MAPS, OR TO SECURE A WATER SOURCE WITH APPROVAL FROM THE COUNTY WATER DISTRICT TO SUPPLY AT LEAST 50 PERCENT OF THE BUILD-OUT.

THEN, ONCE THAT'S BEEN FULFILLED, THEY CAN ALSO GET A THIRD OR SECOND EXTENSION, WHICH WOULD GRANT THREE MORE YEARS OF EXTENSIONS.

AND THAT WOULD BE REQUIRING THEM TO NOT ONLY MEET THE FIRST EXTENSION, BUT THEN TO RECORD A TOTAL OF 151 LOTS.

AND ALSO THE AGREEMENT DOES STATE THAT THEY WOULDN'T PAY FEES AT THIS TIME AT THIS RATE, BUT FEES AT THE TIME OF RECORDING.

AND AT THE RATE OF RECORDING.

HERE IS THE TENTATIVE MAP FOR THE PARKWAY AND PARKWAY PHASE TWO.

I'VE HIGHLIGHTED PARKWAY PHASE ONE IN ORANGE JUST SO THAT YOU CAN DELINEATE THE TWO PHASES. HERE'S THE TENTATIVE MAP FOR PARKWAY PHASE THREE, WHICH IS AGAIN ABOVE THE DELTA MENDOTA CANAL. THE PROJECT SITE IS DESIGNATED LOW DENSITY RESIDENTIAL LAND USE IN THE GENERAL PLAN AND ZONED R1 5000 SINGLE FAMILY MINIMUM LOT, SIZE FIVE THOUSAND.

THE DEVELOPMENT AGREEMENT DOESN'T REALLY CHANGE THE PROJECT, THE PROJECT SITE OR THE SURROUNDING AREA. IT JUST VESTS RIGHTS AS WELL AS PROVIDES KIND OF AN EXTENSION OF TIME ON THESE MAPS. SO THE PROJECT AND THE DEVELOPMENT AGREEMENT IS REMAINING CONSISTENT WITH THE GENERAL PLAN GOALS AND POLICIES AND SANTA NELLA COMMUNITY SPECIFIC PLAN GOALS AND POLICIES, AS WELL AS APPLICABLE PROVISIONS OF THE ZONING CODE THE SUBDIVISION MAP ACT AND TITLE 17 OF OUR MUNICIPAL CODE.

FOR ENVIRONMENTAL REVIEW STAFF HAS DETERMINED THAT THE DEVELOPMENT AGREEMENT IS EXEMPT FROM ENVIRONMENTAL REVIEW PURSUANT TO SECTION 15162 RESIDENTIAL PROJECTS RESIDENTIAL PROJECTS PURSUANT TO A SPECIFIC PLAN.

AND SUBSEQUENTLY EIR'S AND NEGATIVE DECLARATIONS OF THE CEQA GUIDELINES.

THIS IS BECAUSE THE TENTATIVE MAPS THAT WERE APPROVED FALL UNDER THE SCOPE OF THE SANTA NELLA COMMUNITY SPECIFIC PLAN AND THE EIR WHICH WAS PREPARED FOR THE SPECIFIC PLAN, ALSO ANALYZES THE PROJECT SCOPE AND THAT WAS CERTIFIED BY THE BOARD IN 2001.

THE PROJECT DOESN'T HAVE ANY PROJECT SPECIFIC MITIGATIONS, BUT INSTEAD CALLS OUT THAT THE MAPS HAVE TO COMPLY WITH THE APPLICABLE MITIGATIONS OF THE COMMUNITY SPECIFIC PLAN.

AND AGAIN, BECAUSE THE PROJECT INVOLVES VESTED RIGHTS, AN EXTENSION OF THE APPROVED MAPS, IT DOESN'T REALLY CHANGE THE PROJECT, PROJECT SITE, PROJECT ENVIRONMENT SURROUNDING AREA OF THE PROJECT SITE.

SO THERE IS REALLY NO NEED FOR SUBSEQUENT ENVIRONMENTAL REVIEW.

MR. CHAIRMAN OF THE COMMISSION, STEVE MAXEY, DEPUTY DIRECTOR FOR PLANNING FOR THE COUNTY.

I WANT TO CLARIFY ONE THING ON THIS SLIDE.

THE SECOND BULLET THERE.

NO PROJECT SPECIFIC MITIGATIONS.

AT THE TIME THAT EACH OF THESE MAPS WAS APPROVED, THERE WAS NO PROJECT SPECIFIC ENVIRONMENTAL DOCUMENT THAT WAS PREPARED.

AS IT'S KIND OF COVERED HERE.

THE MAPS ARE ALL APPROVED UNDER THE IDEA THAT THE MAPS ARE CONSISTENT WITH THE PLANS OR THE COMMUNITY SPECIFIC PLAN PREPARED FOR THE COMMUNITY.

SO I JUST WANNA MAKE THAT CLEAR FOR THE RECORD.

WHILE THERE'S NO MITIGATION SPECIFIC TO THE PROJECT.

THERE IS MITIGATION BUILT INTO THE ENVIRONMENTAL DOCUMENT FOR THE PLAN ITSELF.

NOTICE OF THIS PUBLIC HEARING WAS MAILED OUT TO PROPERTY OWNERS WITHIN 300 FEET OF THE PROJECT SITE, AS WELL AS PUBLISHED IN THE MERCED SUN-STAR ON JUNE 26TH.

AS OF TODAY, THERE ARE NO COMMENTS THAT HAVE BEEN RECEIVED.

GIVEN THE ANALYSIS DETAILED IN THE STAFF REPORT AND PRESENTED HERE IN SUMMARY FORM IN THIS PRESENTATION, STAFF HAS SOME MOTIONS AND RECOMMENDATIONS FOR THE PLAN COMMISSION.

THAT IS FIRST TO DETERMINE THAT THE PROPOSED DEVELOPMENT AGREEMENT MAY BE FOUND EXEMPT FROM ENVIRONMENTAL REVIEW PURSUANT TO SECTION ONE FIVE ONE SIX TWO SUBSEQUENT EIRS AND NEGATIVE DECLARATIONS AND TWO STAFF RECOMMENDS THAT THE COMMISSION ADOPT RESOLUTION

SO WE AGREE WITH THE STAFF REPORT AND APPRECIATE THAT.

JUST WANT TO GIVE A LITTLE BIT OF BACKGROUND ON THE PROJECT.

I'M HAPPY TO SAY THAT THE PROJECT HAS SURVIVED THE GREAT RECESSION.

IT SURVIVED THE DROUGHT AND ITS SURVIVING COVID.

MY CLIENTS HAVE EVERY INTENT OF DEVELOPING THIS PROJECT.

AS YOU KNOW, IT'S A LOT MORE THAN JUST PAPER LOT MAPS.

WE DID PROCEED WITH IMPROVEMENT PLANS AND STARTED CONSTRUCTION OF THE PROJECT BACK IN THE MID 2000S AND REALLY WAS STOPPED BY THE GREAT RECESSION.

AND THERE WAS A CONTAMINATION ISSUE THAT WE HAD TO WORK THROUGH STARTING ABOUT 2007, YOU KNOW, TOWARDS THE END OF THE GREAT RECESSION AND THEN THE START OF THE DROUGHT.

I THINK CALIFORNIA AND OUR STATE LAW IS GOING TO HAVE TO START TO ADDRESS THE SUBDIVISION MAP BACK AND MAP LIVES BECAUSE THERE IS CONSTRAINTS IN CALIFORNIA AND ADDRESSING JUST LAND USE, BUT ALSO INFRASTRUCTURE AND WATER SUPPLY.

THAT WAS ANOTHER MAJOR ISSUE THAT WE ARE TACKLING ON THIS PROJECT WHERE WE HAVE FINALLY IDENTIFIED A SUSTAINABLE WATER SUPPLY AND WORKING WITH SANTA NELLA COUNTY WATER DISTRICT TO BRING A WATER SUPPLY TO FRUITION.

AND REALLY IN THE MOST RECENT TIMES, THAT HAS BEEN THE HOLD UP ON DELIVERING THE LOTS.

BUT AGAIN, OUR INTENT AND I THINK WHEN YOU SEE THE APPROVAL DATES THAT TIFFANY PRESENTED, WHEN YOU SEE A MAP THAT WAS IMPROVED IN 2003, I THINK IT'S VERY LOGICAL TO ASK, YOU KNOW, AFTER SEVENTEEN YEARS, IS THIS REALLY A PROJECT.

AND I CAN SAY WE HAVE NEVER STOPPED WORKING ON PROVIDING THE SOLUTIONS TO THE PROJECT.

AND WE FEEL THAT WE ARE GETTING VERY CLOSE TO DELIVERING LOTS TO THE MARKET AND FOR THE FACT THAT WE HAVE STARTED IMPROVEMENTS.

WE WANT TO FINISH THOSE.

REALLY ASIDE FROM THAT WE DO SEEK THE SUPPORT OF THE COMMISSION.

WE ARE AVAILABLE TO ANSWER ANY QUESTIONS THAT YOU MAY HAVE.
