AND THE PROJECT BEFORE YOU IS ZONING DEVIATION NUMBER ZD25-002/MINOR SUBDIVISION NUMBER MS25-013 FOR THE APPLICANT, JAMIE MORENO. THE PROJECT IS A REQUEST TO DEVIATE FROM THE REQUIRED MINIMUM 60 FOOT PARCEL WIDTH BY 2.59FT, TO ALLOW FOR THE SUBDIVISION OF AN APPROXIMATELY 16,071 SQUARE FOOT PARCEL INTO TWO PARCELS, RESULTING IN PARCEL ONE 8,035FT². PARCEL TWO APPROXIMATELY 8,036FT².
THERE ARE NO NEW CONSTRUCTIONS OR RESIDENTS BEING PROPOSED WITH THIS SUBDIVISION, AND THE PROJECT SITE IS DESIGNATED WINTON URBAN COMMUNITY LOW DENSITY RESIDENTIAL LAND USE IN THE GENERAL PLAN AND ZONED R-1 SINGLE FAMILY RESIDENTIAL.
THIS IS THE VICINITY OF THE PROJECT SITE OUTLINED IN RED.
THE PROJECT SITE CONSISTS OF ONE PARCEL, APPROXIMATELY 16,071FT² IN SIZE.
THIS IS A MUCH CLOSER VIEW OF THE PROJECT SITE.
THIS IS THE TENTATIVE PARCEL MAP WHICH DISPLAYS THE PROPOSED TWO PARCELS.
PROPOSED PARCEL ONE IS OUTLINED IN RED AND PROPOSED PARCEL TWO IS OUTLINED IN BLUE.
PARCEL ONE WOULD REMAIN WITH THE EXISTING STRUCTURES, SUCH AS THE SINGLE FAMILY HOME AND THE TWO SMALL SHEDS, AND CONTINUE TO HAVE ACCESS OFF CALIFORNIA STREET.
IN PARCEL TWO IT WOULD REMAIN VACANT AND WOULD REQUIRE WATER AND SEWER CONNECTION FROM WINTON WATER AND SANITARY DISTRICT PRIOR TO ANY ISSUANCE OF ANY BUILDING PERMIT OR ANY TYPE OF DEVELOPMENT. IN TERMS OF CONSISTENCY WITH LOCAL REGULATIONS THE PROJECT SITE IS DESIGNATED LOW DENSITY RESIDENTIAL LAND USE IN THE GENERAL PLAN. THE PROJECT IS CONSISTENT WITH THE APPLICABLE GENERAL PLAN POLICIES, INCLUDING, BUT NOT LIMITED TO GOAL LU-1, POLICY LU-1.4, GOAL LU-5.8, AND POLICY LU-5.C.1, AND IS CONSISTENT WITH THE WINTON URBAN COMMUNITY PLAN.
DENSITY STANDARDS AND GOAL LU-1 AND GOAL LU-2, AND IS ALSO CONSISTENT WITH THE APPLICABLE PROVISIONS OF THE SUBDIVISION MAP ACT AND TITLE 17. ADDITIONALLY, THE

PROJECT IS CONSISTENT WITH THE MAJORITY OF THE DEVELOPMENT STANDARDS OF THE MERCED COUNTY ZONING CODE, MEETING THE MINIMUM PARCEL SIZE AND SETBACK AND PARCEL DEATH REQUIREMENTS OF THE R-1 SINGLE FAMILY RESIDENTIAL ZONE DISTRICT OUTLINED IN SECTION 18.12.030, WITH THE EXCEPTION WITH THE EXCEPTION OF THE PARCEL WIDTH, THE PROPOSED DEVIATION OF 2.59FT IS MINOR AND PURSUANT TO SECTION 18.26.020 B, IS CONSISTENT WITH THE APPLICABLE REQUIREMENTS, AS THE MAXIMUM PERMITTED DEVIATION IS 50% OR 9 FEET.PURSUANT TO THE MERCED COUNTY ZONING CODE, SECTION 18.2126.015 AND GOVERNMENT CODE SECTION 65906, A DEVIATION MAY ONLY BE APPROVED AFTER THE PLANNING COMMISSION MAKES THE FOLLOWING REQUIRED FINDINGS.
ONE, THERE ARE SPECIAL CIRCUMSTANCES APPLICABLE TO THE SUBJECT PROPERTY.
THE EXISTING PARCEL DIMENSIONS REGARDING THE PARCEL WIDTH WILL NOT ALLOW A SUBDIVISION THAT WOULD CREATE A PARCEL MEETING THE PARCEL WITH STANDARDS IN AN R-1 ZONE, AND MEET LOW DENSITY RESIDENTIAL DESIGNATION DENSITY STANDARDS.
THE DEVIATION WOULD ALLOW THE PROJECT SITE TO BE DEVELOPED IN A MANNER PERMITTED BY THE ZONING CODE, AND CONSISTENT WITH THE DENSITY STANDARDS FOR THE LAND DESIGNATED LOW DENSITY RESIDENTIAL.
THREE, APPROVING THE DEVIATION WOULD NOT CONSTITUTE SPECIAL PRIVILEGE.
THE PARCELS WOULD STILL MEET THE PARCEL SIZE REQUIREMENT, SETBACKS, AND PARCEL.
IF THE DEVIATION WOULD ALLOW FLEXIBILITY IN THE PARCEL WIDTH SIZE NEEDED TO MEET THE 60 FOOT MINIMUM PARCEL WIDTH REQUIREMENT IN AN R-1 ZONE, AND ALLOW FOR DEVELOPMENT TO BE CONSISTENT WITH THE LOW DENSITY RESIDENTIAL LAND USE.

NOTICE OF THE PUBLIC HEARING WAS PUBLISHED IN THE MERCED COUNTY TIMES AND MAILED TO ALL PROPERTY OWNERS LOCATED WITHIN THE 300FT OF THE PROJECT SITE ON DECEMBER 25TH, 2025. NO COMMENTS WERE RECEIVED. STAFF HAS DETERMINED THAT NO FURTHER ENVIRONMENTAL REVIEW IS REQUIRED PURSUANT TO SECTION 15183.
