THANK YOU. COMMISSIONERS. MY NAME IS YANIRI PIZA, AND I'M THE PROJECT PLANNER FOR CONDITIONAL USE PERMIT NUMBER CUP 25-005 FOR NITRICITY DELHI. THIS PROPOSED PROJECT WAS CONTINUED FROM THE JULY 9TH PLANNING COMMISSION.
STRUCTURES INVOLVED IN THE OPERATION INCLUDE A 12,000 SQUARE FOOT PROCESSING AND STORAGE BUILDING, A 12,000 SQUARE FOOT WAREHOUSE, A LOADING DOCK AND COVERED CANOPY, AND OCCUPY AN OFFICE SPACE.
THE PROPOSED PROJECTS. ADDITIONAL IMPROVEMENTS INCLUDE INTERIOR IMPROVEMENTS WITH THE CONSTRUCTION OF DRY STORAGE FOR ALMOND SHELLS AND INSTALLATION OF A GRINDING AND SIEVING STATION, AND EXTERIOR IMPROVEMENTS WITH THE INSTALLATION OF MECHANICAL, AGRICULTURAL, INDUSTRIAL EQUIPMENT SUCH AS A MIXING AND PACKAGING AREA, INTERCONNECTED EXTRACTION TANKS, AIR PURIFICATION SYSTEM AND OTHER UTILITY UPGRADES.
ALL THESE IMPROVEMENTS WOULD BE WITHIN A 6 MONTH TENANT IMPROVEMENT TIMELINE BEGINNING IN THE SUMMER OF 2025, AND WOULD END AROUND DECEMBER 2025. THIS IS THE VICINITY OF THE PROJECT SITE.
THE 2 BUILDINGS THAT WOULD BE UTILIZED ARE LOCATED ON THE SOUTHEAST OF THE PROJECT SITE.
THE TWO BUILDINGS LOCATED ON THE NORTHEAST ARE NOT INCLUDED IN THE PROPOSED FERTILIZER FACILITY OPERATION, BUT IS INCLUDED IN THIS IMAGERY AS IT INCLUDES SHARED ACCESS TO CIRCULATION OF THE SITE.
THE PROJECT SITE IS ON WELL AND ON SITE SEPTIC SYSTEM.
THERE ARE 2 ACCESS POINTS, ONE ON PINEWOOD STREET AND ONE ON COLLIER ROAD.
HERE IS THE SITE PLAN OF THE PROPOSED FERTILIZER FACILITY.
IN ADDITION TO WHERE IMPROVEMENTS WILL BE OCCURRING IN THE INTERIOR AND EXTERIOR OF THE STRUCTURES, SUCH AS A SMALL CONSTRUCTION IN THE INTERIOR FOR STORAGE, A DRY STORAGE FOR ALMOND SHELLS, AND UPGRADES TO SUPPORTING UTILITIES ON THE INTERIOR AND EXTERIOR OF BUILDINGS.
THE SITE HAS 35 AVAILABLE PARKING SPACES, WITH 33 BEING STANDARD AND 2 BEING ACCEPTABLE.

THE PROJECT IS CONSISTENT WITH GENERAL PLAN GOAL AND POLICIES REGARDING AGRICULTURAL DESIGNATION, AGRICULTURAL SUPPORT FACILITIES AND INDUSTRIAL USES.THE PROJECT SITE IS ALSO ZONED A-1 GENERAL AGRICULTURAL.
THE PROJECT IS CONSISTENT WITH THE APPLICABLE PROVISIONS OF THE ZONING CODE, AND MAY BE PERMITTED IN THE A-1 ZONE, SUBJECTED TO APPROVAL OF A CONDITIONAL USE PERMIT.

WHEN WE RECEIVED WE THE FORMAL COMMENT LETTER ON JULY 9TH, WE ISSUED A NEW RESPONSE COMMENT AS PART OF OUR PUBLICATION OF THE STAFF REPORT. AND THEN AFTER CLOSE OF BUSINESS YESTERDAY, JULY 22ND, WE RECEIVED AN ADDITIONAL LETTER FROM LEADERSHIP COUNCIL DATED JULY 21ST, 2025 VIA EMAIL. A COPY OF THIS LETTER HAS BEEN PROVIDED TO THE DAIS, AND ADDITIONAL COPIES ARE AVAILABLE ON THE TABLE AT THE ENTRANCE OF THE PLANNING COMMISSION CHAMBERS. SO THE CONTENTS OF THE ORIGINAL LETTER KIND OF BREAKS DOWN LEADERSHIP COUNCIL'S 3 PRIMARY CONCERNS, WHICH IS THAT THE PROJECT HAS UNDISCLOSED IMPACTS, SPECIFICALLY THOSE RELATED TO WATER, ELECTRICITY USAGE, NITROGEN OXIDE EMISSIONS, TRANSPORTATION RELATED EMISSIONS, HANDLING OF HAZARDOUS MATERIALS.
BECAUSE OF THESE REASONS, THE PROJECT IS NOT EXEMPT FROM CEQA.
ALSO, BECAUSE THE PROJECT IS GOING TO BE A CHANGE OF USE AND DOES HAVE SOME IMPROVEMENTS INVOLVED THAT THE LEADERSHIP COUNCIL BELIEVES THAT THE PROJECT IS NOT EXEMPT FROM CEQA, AND SINCE BECAUSE IT'S NOT EXEMPT FROM CEQA, THE COUNTY SHOULD HAVE AND COMPLETE A FULL ENVIRONMENTAL REVIEW FOR THIS PROJECT.
NEXT SLIDE. IN THE COUNTY'S INITIAL RESPONSE TO THIS LETTER, SEEN AS ATTACHMENT G, WE DID NOTE THAT THE PROJECT IS NOT LOCATED IN THE URBAN COMMUNITY OF DELHI. IT IS LOCATED IN THE AGRICULTURAL AREAS OUTSIDE OF DELHI, ABOUT 0.75 MILES SOUTH OF THE URBAN COMMUNITY BOUNDARY, WATER DEMAND WOULD ACTUALLY BE REDUCED FROM THE PRIOR AGRICULTURAL INDUSTRIAL PROCESSING FACILITY, AND IT WOULD BE UTILIZING RENEWABLE ENERGY UNLIKE THE PREVIOUS USAGE.
SO ALTHOUGH ENERGY USAGE WOULD BE INCREASING, THE OFFSET WOULD BE RENEWABLE ENERGY.
AS FAR AS EMISSIONS, THE APPLICANT IS WORKING WITH A DISTRICT OR AIR PERMITTING ENGINEER AND WORKING WITH THE AIR DISTRICT TO ENSURE THAT THEIR OPERATIONS DO COMPLY WITH THE AIR DISTRICT STANDARDS FOR QUALITIES, SO THEY WILL BE UTILIZING BEST AVAILABLE CONTROL TECHNOLOGIES, WHICH WILL MINIMIZE EMISSIONS AND WOULD NOT RESULT IN HARMFUL IMPACTS TO THE SURROUNDING AREA.
AS FAR AS TRANSPORTATION EMISSIONS, THOSE WOULD BE LESS THAN SIGNIFICANT AS THE PROJECT WOULD HAVE SIGNIFICANT LESS VEHICLE TRIPS ASSOCIATED WITH THE PROJECT, SPECIFICALLY, LESS THAN 2 TRUCK TRIPS PER DAY.
APPROXIMATELY 1.67 TRIPS MEAN THAT SOME DAYS THEY MIGHT NOT RECEIVE 2 TRIPS THEY MIGHT HAVE LESS THAN THAN 2, RIGHT? AND THEN FINALLY, AS FAR AS USING HAZARDOUS MATERIALS BUSINESS PLAN IS REQUIRED FOR ANY PROJECT THAT HAS A CERTAIN AMOUNT OF CHEMICALS THAT ARE USED, INCLUDING HOUSEHOLD CLEANERS.
SO IN THAT WITH REQUIREMENT OF AND COMPLYING WITH OUR HAZARDOUS MATERIAL BUSINESS PLAN PROCESS, THEY WOULD HAVE SAFE STORAGE AND HANDLING OF THOSE CHEMICALS.
NEXT SLIDE. REGARDING THE PROJECT NOT BEING EXEMPT FROM CEQA, THE PROPOSED PROJECT IS AN AGRICULTURAL PROCESSING FACILITY, ALMOST AS A FERTILIZER PLANT. THE FACILITY WOULD OPERATE IN EXISTING STRUCTURES AND THE IMPROVEMENTS THAT ARE MADE ARE UTILITY IMPROVEMENTS WITH SOME MECHANICAL EQUIPMENT'S TO ASSIST WITH PRODUCTION OF THEIR PROPERTIES.
THE PROJECT IS RELATIVELY SMALL IN SCALE, AS OPPOSED TO OTHER WELL KNOWN FERTILIZER FACILITIES.

HANDLING OF HAZARDOUS MATERIALS AND AIR PERMITS.NEXT SLIDE. AND FOR ALL THOSE REASONS, BECAUSE WE BELIEVE IT IS CATEGORICALLY EXEMPT, IT'S DEALING WITH MINOR ALTERATIONS TO EXISTING FACILITIES, MOSTLY UTILITY UPGRADES AND USING MECHANICAL EQUIPMENT THAT IS TYPICAL OF AGRICULTURAL INDUSTRIAL PROCESSING PLANTS, THAT ENVIRONMENTAL ANALYSIS IS NOT REQUIRED. NOW I'LL MOVE ON TO THE LETTER THAT WAS RECEIVED YESTERDAY EVENING AFTER CLOSE OF BUSINESS, WHICH KIND OF SUMMARIZED IN TO 3 LARGE PARTS.
THEREFORE, HEALTH RISK IMPACT HAS NOT BEEN QUANTIFIED AND WE SHOULD NOT BE STATING THAT THERE WON'T BE HEALTH IMPACTS AND THAT A CUMULATIVE ERROR ANALYSIS SHOULD HAVE BEEN REQUIRED. IN REGARDS TO THAT, THE COUNTY DOES RECOGNIZE THAT THE AIR DISTRICT HAS THE SCOPE AND JURISDICTION OF AIR QUALITY AND AIR QUALITY EMISSIONS IN THE SAN JOAQUIN VALLEY. THEREFORE, ALL THE PROCESSES THAT THEY'RE WORKING THROUGH THAT THE APPLICANT AND YORKE ARE WORKING THROUGH HAVE CONDUCTED ANALYSIS, ARE IN LINE WITH THE AIR DISTRICT'S PROCESSES.
SO THEY HAVE MADE AN INFORMED ESTIMATED GUESS THAT THERE WOULD NOT BE A HEALTH RISK IMPACT, WHICH WILL HAVE TO BE VALIDATED BY THE AIR DISTRICT.
AND IF IT IS NOT VALIDATED BY THE AIR DISTRICT, THE AIR DISTRICT CANNOT ISSUE THEIR AUTHORITY TO CONSTRUCT, WHICH MEANS THEY CANNOT OPERATE. SO REGARDLESS OF WHETHER THE PLANNING COMMISSION DOES APPROVE THIS PROJECT, THIS PROJECT COULD NOT OPERATE IF THE AIR DISTRICT DOES NOT ISSUE ITS APPROVALS.
AND THEN A CUMULATIVE ANALYSIS IS NOT REQUIRED BECAUSE, AS DISCUSSED IN YORKE'S LETTERS AND AS DISCUSSED IN THEIR CONCLUSIONS, THE PROJECT DOES NOT EXCEED THE THRESHOLDS OF SIGNIFICANCE THAT ARE SET BY THE ER DISTRICT.
THAT STILL DOESN'T GUARANTEE THAT THEY WOULD CONSTITUTE A SIGNIFICANT CUMULATIVE IMPACT.
THE ADDITIONAL POINTS THAT THE COMMENT LETTER STATES IS THAT THE PROJECT IS NOT SIMILAR TO THE PRIOR AGRICULTURAL PROCESSING USE, BECAUSE THEY ARE CONSTRUCTING NEW THINGS WITH INSIDE THEIR BUILDING AND INSTALLING NEW MECHANICAL EQUIPMENT.
SPECIFICALLY CITING AN ARTICLE THAT THE NITRICITY WOULD BE USING BIOMASS AND HEAT WITH RENEWABLE ELECTRICITY, BIOMASS AND HEAT IS NOT AN ELECTRICAL USAGE. THAT'S KIND OF THE ADDITIVES TO THE PROCESS.
AND THE AS STATED IN THAT ARTICLE, THEY WILL BE USING RENEWABLE ENERGY.
THEREFORE WE BELIEVE THAT THIS PROJECT SHOULD NOT HAVE ANY SIGNIFICANT ENVIRONMENTAL IMPACTS WOULD FALL WITHIN THE ENVIRONMENTAL CEQA EXEMPTION CRITERIA AND THEREFORE NO FURTHER ENVIRONMENTAL REVIEW IS REQUIRED.
THAT CONCLUDES THE COMMENTS RECEIVED ON THIS PROJECT AS WELL AS THE COUNTY'S RESPONSES.

DETERMINE THE PROJECT IS CATEGORICALLY EXEMPT FROM ENVIRONMENTAL REVIEW PURSUANT TO SECTION 15301 EXISTING FACILITIES AND SECTION 15303 A NEW CONSTRUCTION OR CONVERSION OF SMALL STRUCTURES OF THE CEQA GUIDELINES AND APPROVE CONDITIONAL USE PERMIT NUMBER CUP 25-005. WE ARE HEARING THAT THE ALTERATIONS WOULD BE MINOR, BUT I THINK THAT THE USES AND LIKE THE EMISSIONS THAT WILL BE HAPPENING TO MAKE THE FERTILIZERS FROM THE ALMOND HUSK ARE WHAT WE'RE MOST CONCERNED ABOUT AND WHAT MAKE THIS PROJECT NOT EXEMPT FROM CEQA.
AND ADDITIONALLY, I WOULD PLEASE LIKE TO ASK IF YOU CAN CONFIRM OR DENY IF THERE WILL BE BIOMASS ENERGY BEING USED IN THE PROJECT TO CARRY OUT THE CREATION OF THE FERTILIZER OR TO TO RUN THE FACILITY ITSELF, AND IF BIOMASS ENERGY WILL BE BEING USED, TO WHAT EXTENT AND IN WHAT WAYS AND AGAIN, AT THIS MOMENT, WE ASK COMMISSIONERS TO DELAY THIS PROJECT AND ITS APPROVAL UNTIL THE HEALTH RISK ASSESSMENT HAS BEEN COMPLETED.
