CUP21-004 IT IS TO I APOLOGIZE FOR THAT. BEFORE THIS MORNING IS CONDITIONAL USE PERMIT APPLICATION NO.

CUP21-004. IT IS TO BRING A COMPLIANCE, AN EXISTING EVENT VENUE THAT IS LOCATED EAST OF WINTON & NORTH OF THE CASTLE AIRPORT.

IT IS LOCATED ON THE SOUTHWEST CORNER OF BUHACH ROAD AND EUCALYPTUS AVE.

THERE ARE A VARIETY OF STRUCTURES ON THIS PROPERTY AS I MENTIONED, THE ONES THAT ARE NOT BEING UTILIZED FOR THE EVENT VENUE, WHICH IS A SINGLE-FAMILY RESIDENCE PRIMARILY USED BY THE PROPERTY OWNER.

THERE ARE VARIOUS ANCILLARY BUILDINGS, SHEDS AND OUTBUILDINGS, BUT THERE'S ALSO TWO PERMITTED MOBILE HOME RESIDENCES ON THE SITE, WHICH ARE FOR IMMEDIATE FAMILY AND FOR AGRICULTURAL EMPLOYEES.

ACCESS TO EVENT VENUE WOULD BE PROVIDED FROM EUCALYPTUS AVE.

ONE OF THE RESIDENCES DOES HAVE ACCESS THROUGH A NORTH BUHACH ROAD THAT'S TO THE EAST OF THE SITE.

THE EVENT VENUE AND RESIDENCES RECEIVE WATER FROM AN EXISTING WELL ON SITE, AND THEY RECENTLY REDID THEIR SEPTIC SYSTEM AS WELL.

THE PROPERTY IN TOTAL IS APPROXIMATELY 16-ACRES.

THE EVENT VENUE USES APPROXIMATELY 3.6-ACRES, WITH 1.7 ACRES BEING USED FOR THE BARN, WHICH IS THE PRIMARY FOCAL POINT ON SITE. THERE'S A PHOTO AREA, A LARGE POND AREA, LAWN AREA WHICH PEOPLE CAN PLAY GAMES AND RESTROOMS. THERE ALSO IS APPROXIMATELY 1.9 ACRES THAT'S RESERVED FOR THE PARKING, WHICH THEY DO HAVE A VARIETY OF PARKING, PAVED, ACCESSIBLE, AS WELL AS A GRAVEL OVERFLOW PARKING AREA.

THE EVENT VENUE PROPOSES TO USE OR PROPOSES TO HAVE A MAXIMUM OF 200 PEOPLE.

THE EVENT ORGANIZERS, WHICH IS NOT THE PROPERTY OWNER OR THE APPLICANT.

THE EVENT ORGANIZERS ARE RESPONSIBLE FOR STAFFING, CATERING, CLEANUP AND SECURITY.

THE APPLICANT DOES ANTICIPATE HAVING APPROXIMATELY 35 EVENTS PER YEAR, WHETHER IT BE FOR FAMILY EVENTS OR FOR MORE OPEN FOR RENTALS.

THIS IS THE LOCATION OF THE SITE WITHIN PROXIMITY TO THE SURROUNDING USES.

JUST TO THE SOUTH, I MENTIONED THERE AS CASTLE AIRPORT.

THIS PROJECT IS LOCATED ON THE CORNER OF EUCALYPTUS AND BUHACH AS I PREVIOUSLY MENTIONED.

IT IS SOUTH OF MERCEDES AVE. IT IS TO THE EAST OF SCHAEFER ROAD.

BUT AS YOU CAN TELL FROM THIS AERIAL PHOTOGRAPH, IT IS PERMANENTLY SURROUNDED BY AGRICULTURAL USES TO THE NORTH AND EAST.

TO THE WEST, THERE ARE A LOT OF AGRICULTURAL OR RURAL RESIDENTIAL USE UNITS IN THAT AREA, AS WELL AS THE CASTLE AIRPORT, WHICH IS A MORE OF AN INDUSTRIAL TYPE OF USE.

THE PROJECT SITE, AS YOU CAN SEE, IS KIND OF THIS IS HOW IT'S LAID OUT.

THE EVENT VENUE IS TURNED TOWARDS THE SOUTHERN PART OF THE PROPERTY.

THERE IS THAT ONE RESIDENCE ALONG NORTH BUHACH ROAD, WHICH HAS THE ONLY ACCESS POINT ON BUHACH ROAD.

AS I MENTIONED, THERE ARE A COUPLE OF ACCESS POINTS ON EUCALYPTUS AVE, WITH THE PRIMARY ENTRANCE TO THE VENUE BEING THE ONE WITH THE ARROW THERE.

THERE ARE THE RESIDENCES TO THE WEST OF THE VENUE.

THE POND, AS I PREVIOUSLY MENTIONED, IS ON THE SOUTHERN PROPERTY LINE, AS WELL AS THE OPEN AREA THAT IS ALSO UTILIZED BY THE EVENT VENUE.

THIS IS THE PROJECT SITE THAT THE APPLICANT SUBMITTED.

AS YOU CAN SEE, THE BARN LOCATION WITH HOW THE PARKING IS LAID OUT WITH THE OVERFLOW BEING WITH THOSE ARROWS ARE LOCATED AT.

THERE ALSO IS ENOUGH OF A RADIUS FOR ANY KIND OF EMERGENCY VEHICLES WILL TURN AROUND WITHIN THE GRAVEL AREA OF THE EVENT VENUE.

AND THEN AS YOU CAN NOW SEE WITH THE PHOTOGRAPH, I'LL SHOW YOU THIS ONE QUICKLY IS THERE'S A SEPARATION OF A FENCE BETWEEN THE NON-EVENT VENUE FACILITIES AS WELL AS WITH THE EVENT VENUE.

THE PROJECT BEFORE YOU IS CONSISTENT WITH THE GOALS OF THE MERCED COUNTY GENERAL PLAN, WHICH IS TO PRESERVE, PROMOTE AND EXPAND AGRICULTURAL INDUSTRY. INDUSTRY DOES EXPAND BEYOND JUST AGRICULTURAL USES.

IT DOES ALLOW FOR COMMERCIAL AND INDUSTRIAL TYPES OF USES WITHIN THE AGRICULTURAL AREA, PROVIDED THEY DO NOT CONFLICT WITH NEIGHBORING AGRICULTURAL INDUSTRIES. WHICH IS, THAT'S HOW WE'RE USING THIS TO JUSTIFY THE CONSISTENCY WITH THE GENERAL PLAN.

AS FOR THE AGRICULTURAL ELEMENT IS TO FURTHER DEVELOP AND EXPAND AGRICULTURAL TOURISM AND RECREATION INDUSTRY WITHIN MERCED COUNTY.

I MENTIONED THIS USE DOES NOT INTERFERE WITH THE EXISTING OR HISTORICAL AGRICULTURAL PRACTICES OF THE SITE OR WITH THE NEIGHBORING AREA.

IT WILL NOT CONFLICT WITH THE AGRICULTURAL USES TO THE EAST, OR WITH THE HISTORICAL RESONANCES TO THE WEST.

ALSO, WE DID AN ACCOUNT LETTER OUT TO THE AIRPORT USE COMMISSION COMMITTEE.

AND THEY ALSO MENTION THAT THE NUMBER OF APPLICANTS WILL NOT INTERFERE WITH THE MAP FOR THE AIRPORT COMMISSION FOR DENSITY OF PEOPLES PER ACRE. AS FOR THE ACTUAL ZONING CODE, THE USE WE CONSIDERED A RECREATIONAL EVENT AS DEFINED BY OUR ZONING CODE, WHICH IS DEFINED AS A USE OF THE PROPERTY OR ONSITE FACILITY FOR WHICH A FEE IS CHARGED FOR A WEDDING OR SIMILAR PRIVATE EVENT. THEY DO HAVE A VARIETY OF WEDDINGS THAT DO OCCUR DURING THE YEAR, AS WELL AS OTHER EVENTS. THAT DO OCCUR WITHIN THIS LOCATION, THE LOCATION WOULD BE CONSIDERED TO ACQUIRE THE REGULATIONS FOR OFF-STREET PARKING. THE NUMBER OF PARKING SPACES THAT WOULD BE REQUIRED FOR THE SITE IS 21 SPACES.

THE PROPOSED PARKING AREA WOULD BE MORE THAN SUFFICIENT, AS THEY ARE PROPOSING TO HAVE 2 ACCESSIBLE PARKING SPACES, 8 PAVED PARKING SPACES AS WELL AS 60 PARKING SPACES FOR VARIOUS VEHICLES, WHICH IS BASICALLY IN COMPLIANCE WITH OUR ZONING CODE FOR PARKING ASPECTS.

AS FOR THE ENVIRONMENTAL ASPECT OF THE PROJECT, THE STAFF DID PUBLISH A NOTICE OF INTENT (NOI) ON MARCH 12TH, 2025. THE NOTICE WAS CIRCULATED FOR APPROXIMATELY 30 DAYS.

WE ALSO MAILED OUT 300-FOOT [LAUGHTER] NOTICES TO THE NEIGHBORHOOD, AS WELL AS PUBLISHED IN THE MERCED COUNTY TIMES, AS WELL AS POSTED AT THE COUNTY ADMIN BUILDING BY THE MERCED COUNTY CLERK.

THE NOTICES WERE EMAILED OUT ON MARCH 14TH. THE NOTICE OF INTENT (NOI) 30-DAY COMMENT PERIOD ENDED ON APRIL 14TH.

STAFF DID NOT RECEIVE ANY COMMENTS FROM ANY CONSTITUENTS OR ANY OTHER AGENCIES OR DEPARTMENTS.

THE PUBLIC HEARING NOTICES WERE ALSO THEN PUBLICIZED ON MAY 29TH, AGAIN PUBLISHED IN THE MERCED COUNTY TIMES.

AND THEN WE STAFF DID SEND OUT ANOTHER ROUND OF 300 NOTICES TO NEIGHBORING PROPERTY OWNERS.

AND ALSO WE DID NOT RECEIVE ANY COMMENTS FROM THE NEIGHBORS OR FROM ANY OTHER CONSTITUENTS IN THE AREA.

AS FOR THE ENVIRONMENTAL REVIEW STAFF WORKED WITH ENVIRONMENTAL CONSULTANT WHO IS ON THE PHONE WITH US TODAY TO CREATE AN INITIAL STUDY, AND THEY CREATED A NEGATIVE DECLARATION. THERE ARE A NUMBER OF MITIGATION MEASURES THAT ARE INCLUDED WITH THE STAFF REPORT THAT WERE THEN CONDITIONED AS PART OF THE CONDITIONS OF APPROVAL. SOME OF THE ITEMS THAT WE LOOKED AT WERE BIOLOGICAL RESOURCES, CULTURAL RESOURCES, GEOLOGY AND SOILS, GREENHOUSE GAS EMISSIONS, HYDRAULIC, WATER QUALITY, AS WELL AS TRAFFIC AND CIRCULATION. THE AS I MENTIONED EARLIER, IT WAS CIRCULATED ON MARCH 13TH WITH LOCAL AND STATE AGENCIES. THE 30-DAY REVIEW PERIOD EXPIRED ON APRIL 14TH.

WE DID NOT RECEIVE ANY NOTICES OR COMMENTS FROM THE COMMUNITY.

ALSO, THE NOTICE OF INTENT WAS PUBLISHED ON THE STATE CLEARINGHOUSE UNDER (SCH# 2025030379) TO VARIOUS STATE AGENCIES. AGAIN, WE RECEIVED NO COMMENTS FOR THIS EVENT VENUE.

BEFORE YOU TODAY STAFF IS ASKING YOU TO CONSIDER ADOPTING MITIGATED NEGATIVE DECLARATION (SCH# 2025030379) AND MITIGATION MONITORING AND REPORTING PROGRAM (MMRP) FOR THE PROJECT PURSUANT TO SECTION 15074 OF THE CEQA GUIDELINES AND THE 7 CEQA F INDINGS DESCRIBED WITHIN THE PREPARED STAFF REPORT.

AND THEN IF YOU GUYS ARE ABLE TO, IF THE COMMISSION IS ABLE TO MAKE THAT MOTION AND ADOPT IT UNDER CONSIDERATION.

STAFF IS THEN ASKING THE COMMISSION TO APPROVE CONDITIONAL USE PERMIT APPLICATION NO.

CUP 21-004, BASED UPON THE FINDINGS INCLUDED IN THE STAFF REPORT AND SUBJECT TO THE CONDITIONS OF APPROVAL AND 8 FINDINGS AS OUTLINED IN SECTION 18.116.040 AND DESCRIBED WITHIN THE PREPARED STAFF REPORT.

THIS CONCLUDES STAFF REPORT AT THIS TIME. ARE THERE ANY QUESTIONS FOR STAFF? S O THE INITIAL REQUEST OF THE APPLICANT WAS REQUIRED TO MAKE CHANGES TO THE SEPTIC SYSTEM SO THEY HAD TO RELOCATE THE SEPTIC SYSTEM. I'LL GO BACK TO THE SITE PLAN.

THE ORIGINAL SEPTIC SYSTEM WAS LOCATED WITHIN THE PARKING LOT AREA.

AFTER STAFF SPOKE WITH THE APPLICANT AND OUR HEALTH DEPARTMENT, THEY HAD TO RELOCATE THE SEPTIC SYSTEM TO BE OUTSIDE OF THE PARKING AREA.

AND THAT HAS ALREADY BEEN COMPLETED AND APPROVED BY OUR HEALTH DEPARTMENT.

THANK YOU. ANY OTHER QUESTIONS FOR STAFF? I HAVE ONE, WE NEVER REALLY SPEAK TO THERE WAS AN AGRITOURISM ELEMENT THAT WAS PART OF THIS, THAT YOU DIDN'T SPEAK TO. COULD YOU MAYBE EXPLAIN HOW THAT FITS THIS PROJECT? OUR GENERAL PLAN DOES MENTION THAT IT DOESN'T NEED TO CONFLICT WITH THE EXISTING AGRICULTURAL INDUSTRIES.

I DID TALK TO APPLICANT, AND THEY ARE ABLE TO EXPAND UPON HOW THIS FACILITY SUPPORTS AGRITOURISM IN THE AREA.

OR WHEN WE'VE HAD EVENTS IN THE PAST. THEY'VE COME IN AND, THEY HAVE COME DONE FISHING WITH THEIR CHILDREN SO WE KIND OF PROMOTE THAT.

AND ALSO THERE'S A LOT OF WILD DUCKS AND THINGS LIKE THAT SO WE USUALLY KEEP OUT A LITTLE BIT OF BIRD SEED.

AND SO IT'S REALLY JUST BECOME LIKE A WE HAVE IT FENCED OFF, SO YOU CAN'T REALLY GO INSIDE IT, BUT IT'S VERY LOW AND WE HAVE A GATE AND WE'LL TAKE CHILDREN IN THERE AND THINGS LIKE THAT WITH THEIR PARENTS TO KIND OF HAVE THAT INTERACTION.

SO IT'S REALLY PROBABLY THE MOST EXCITING PART OF THE WHOLE PLACE.

BUT MY DAD ALSO HAS ON THE PROPERTY SOME HORSES, AND HE DOES HAY IN THE SURROUNDING FIELDS AND SOMETIMES LIKE LITTLE OTHER CROPS, OR WE DO JUST A LOT OF WILDFLOWERS A LOT OF TIMES, AND SO WE JUST REALLY TRY TO KEEP IT.

IT'S IMPORTANT TO US TO JUST HAVE THAT ENVIRONMENTAL FEEL OF PROTECTING EVERYTHING.

WE HAVE EVERYTHING KIND OF PROTECTED THAT WE DON'T WANT PEOPLE WALKING ON.

AND THEN WE JUST TRY TO LIKE, ENCOURAGE PEOPLE TO, YOU KNOW, GO OUT AND TAKE PICTURES AND JUST A LOT OF THE NATURAL THINGS, THE BIRDS HAVE BROUGHT IN BEAUTIFUL TREES AND ALL KINDS OF THINGS OUT THERE LIKE THAT.

SO IT'S REALLY IT'S REALLY BEEN A GOOD I THINK, PROMOTIONAL PART OF THAT.

SO IT WOULD BE PROBABLY 99% WEDDINGS. I WOULD NOT BE DOING OTHER, LIKE YOU KNOW, MAYBE WEDDING ANNIVERSARIES, MILESTONE THINGS, BUT NOT QUINCEAÑERA TYPE THINGS OR BIG PARTY TYPE THINGS.

WE WANT IT TO BE KIND OF AN ACCESS. WE WANT THE COMMUNITY TO HAVE ACCESS TO AN OUTDOOR EVENT PLACE THAT'S YOU KNOW, JUST FOR THAT REALLY TO MAKE IT SPECIAL.

MY PROBLEM WITH THIS IS, AND NOT THAT IT STOPS IT, BUT IT'S REALLY MORE WITH OUR CODE IS THE AGRITOURISM ELEMENT.

I T'S A WEDDING VENUE THAT THERE'S NO AGRITOURISM THAT HAPPENS.

BUT THE WAY THAT OUR CODE'S WRITTEN AND IT ALLOWS FOR IT AND IT'S A PROPER USAGE ACCORDING TO WHAT THE CODE SAYS TODAY.

BUT MOVING FORWARD, YOU KNOW, I WOULD LIKE TO SEE STRENGTHEN THE AGRITOURISM ELEMENT TO THAT YOU KNOW.

SO THAT WOULD BE IN MY MIND, MAYBE YOU HAD A BEE FARM THERE AND YOU HAVE BEEHIVES APART AND YOU SHOW PEOPLE HOW THEY GROW.

OR IF YOU LOOK AT THE ULTIMATE EXAMPLE WOULD BE LIKE A HILMAR CHEESE, YOU GO THERE AND THEY HAVE, YOU KNOW, LITTLE CREAMERIES RUNNING AND THINGS THAT ACTUALLY BRING YOU TO BE PART OF AGRICULTURE.

I CAN SEE THAT AS BEING A GREAT TRIGGER FOR AN AGRITOURISM, NOT UPON NECESSARILY, BECAUSE THAT'S NOT EXPLAINING.

AGAIN, IT MEETS THE CRITERIA FOR THIS PROJECT, BUT JUST MOVING FORWARD, IF THAT MAKES SENSE.
