AND THE PROJECT BEFORE YOU TODAY IS MINOR SUBDIVISION NUMBER MS25-001 FOR THE APPLICANT, DAVID THEODORE.

THE PROJECT IS A REQUEST TO SUBDIVIDE AN APPROXIMATELY 304 ACRE PARCEL INTO ONE PARCEL AND A REMAINDER, RESULTING IN PARCEL ONE, APPROXIMATELY 20.32 ACRES AND THE REMAINDER PARCEL APPROXIMATELY 284.39 ACRES.

THERE IS NO DEVELOPMENT PROPOSED, AND THE PROJECT SITE IS DESIGNATED AGRICULTURAL LAND USE IN THE GENERAL PLAN AND ZONED A-1 GENERAL AGRICULTURE.

THIS IS THE VICINITY OF THE PROJECT SITE. THE SITE IS OUTLINED IN RED AND IS LOCATED ON THE NORTHEAST CORNER OF WEST ATWATER JORDAN ROAD AND NORTH HOWARD ROAD IN THE LIVINGSTON AREA. HOWARD LATERAL RUNS ALONG THE EASTERN SIDE OF THE PARCEL BEGINNING AT SUNSET DRIVE, CONTINUING DOWN WASHINGTON BOULEVARD AND ONTO ATWATER JORDAN ROAD.

ACCESS IS PROVIDED ALONG ATWATER JORDAN ROAD, WITH TWO FULL ACCESS DRIVEWAYS LEADING TO THE PRIMARY HOME.

THE SURROUNDING USES ARE CHARACTERIZED BY AGRICULTURAL LAND USES WITH DISPERSED RURAL RESIDENCES, ORCHARDS, AND ROW CROPS. THIS IS A CLOSE UP OF THE PROJECT SITE.

THE SITE MAINTAINS THREE RESIDENCES AT 3,311 SQUARE FOOT SINGLE FAMILY HOME, 01,764 SQUARE FOOT MOBILE HOME AND A 01,560 SQUARE FOOT MOBILE HOME AND ASSOCIATED ACCESSORY STRUCTURES SUCH AS A WAREHOUSE, A BARN, AND A GARAGE. THE REMAINING ACREAGE IS AGRICULTURAL LAND FARMED WITH ROW CROPS AND ORCHARDS.

THERE ARE FOUR IRRIGATION WELLS THAT PROVIDE WATER TO THE AGRICULTURAL FIELDS, AND ADDITIONALLY THERE IS AN EXISTING 151.30KW SOLAR FIELD THAT POWERS THE CURRENT AGRICULTURAL OPERATIONS. WATER IS PROVIDED THROUGH TWO DOMESTIC WELLS, AND EACH HOME MAINTAINS AN INDIVIDUAL SEPTIC SYSTEM.

THIS IS THE PROPOSED TENTATIVE PARCEL MAP. PARCEL ONE APPROXIMATELY 20.32 ACRES OUTLINED IN RED, AND THE REMAINDER PARCEL APPROXIMATELY 284.39 ACRES, OUTLINED IN BLUE.

HERE IS A CLOSE UP OF THE TENTATIVE PARCEL MAP.

PARCEL ONE WOULD MAINTAIN THE PRIMARY 3311 SQUARE FOOT HOME, WITH ITS OWN PRIVATE WELL AND SEPTIC SYSTEM.

ACCESS WOULD CONTINUE TO BE PROVIDED THROUGH THE TWO EXISTING DRIVEWAYS ONTO ATWATER JORDAN ROAD.

THE PROJECT IS CONSISTENT WITH THE APPLICABLE GENERAL PLAN POLICIES, INCLUDING BUT NOT LIMITED TO GOALS LU 2, AG 2, AND AG 3, AND IS CONSISTENT WITH APPLICABLE PROVISIONS OF THE SUBDIVISION MAP ACT AND TITLE 17.

IN COMPLIANCE WITH POLICY, AG 3.12 STAFF HAS RECOMMENDED THE FINAL MAP INCLUDE A NOTE STATING THAT ANY NEW RESIDENCES WILL REQUIRE A CONDITIONAL USE PERMIT FROM THE COUNTY. ADDITIONALLY, THE PROJECT IS CONSISTENT WITH THE APPLICABLE GOALS AND DEVELOPMENT STANDARDS OF THE MERCED COUNTY ZONING CODE, MEETING THE MINIMUM PARCEL SIZE REQUIREMENTS OF THE A-1 GENERAL AGRICULTURAL ZONE DISTRICT, AS OUTLINED IN SECTION 18.10. STAFF HAS FOUND THAT NO FURTHER ENVIRONMENTAL REVIEW IS REQUIRED PURSUANT TO SECTION 15162, SUBSEQUENT EIRS AND NEGATIVE DECLARATIONS OF THE CEQA GUIDELINES.

THE PROJECT SITE BORDERS THE CITY OF MERCED TO THE EAST AND THE SOUTH.

THIS IS A TENTATIVE MAP WHICH DISPLAYS THE FOUR PROPOSED ONE ACRE PARCELS AND THE 4.67 REMAINDER PARCEL.

THE EXISTING SINGLE FAMILY HOME AND ASSOCIATED STORAGE STRUCTURE WOULD BE DEMOLISHED PRIOR TO ANY NEW DEVELOPMENT.

THE ENVIRONMENTAL HEALTH MEMO DATED JANUARY 29, 2025, ADDRESSES THE PROJECT'S SLOW PERCOLATION RATES, THEREFORE REQUIRING AN ADVANCED UNIT TREATMENT UNIT SYSTEM AND AN ADDITIONAL LEACH FIELD AREA AS SHOWN ON THE TENTATIVE MAP.

THE DIVISION OF ENVIRONMENTAL HEALTH HAS REVIEWED AND DETERMINED THAT THE PARCELS WOULD HAVE ADEQUATE SPACE TO SUPPORT INDIVIDUAL DOMESTIC WELLS AND ON SITE SEPTIC SYSTEMS SHOULD DEVELOPMENT OCCUR. THE TENTATIVE MAP WAS ALSO REFERRED TO THE CITY OF MERCED, AND AT THE TIME OF DEVELOPMENT OF PROPOSED PARCEL 4 ENGINEER DESIGNS, WOULD NEED TO BE SUBMITTED TO THEIR ENGINEERING DEPARTMENT FOR POTENTIAL FUTURE CORNER LANE.

THESE COMMENTS CAN BE SEEN ON ATTACHMENT C OF THE STAFF REPORT.

THE PROJECT IS CONSISTENT WITH THE APPLICABLE GENERAL PLAN POLICIES, INCLUDING BUT NOT LIMITED TO GOAL LU-1 AND GOAL HE-1, AND IS CONSISTENT WITH APPLICABLE PROVISIONS OF THE SUBDIVISION MAP ACT AND TITLE 17.

THE PROJECT CONSISTS OF THE DIVISION OF PROPERTY IN AN URBANIZED AREA, ZONED RESIDENTIAL INTO FOUR OR FEWER PARCELS, AND IS IN CONFORMANCE WITH THE GENERAL PLAN AND ZONING, WITH NO VARIANCES OR EXCEPTIONS REQUIRED. THE PROPOSED PARCELS MAINTAIN ADEQUATE SPACE TO HAVE INDIVIDUAL DOMESTIC WELLS AND ON SITE SEPTIC SYSTEMS, WHICH WOULD BE SUBJECT TO PERMITS ISSUED BY ENVIRONMENTAL HEALTH DIVISION AND WOULD HAVE ACCESS AVAILABLE TO LOCAL STANDARDS.

THE REQUEST IS TO CONSTRUCT AND OPERATE A SAND DRYING PLANT AND A PRECAST CONCRETE MANUFACTURING FACILITY AS AN ADDITION EXPANSION TO AN

ADJACENT READY MIXED CONCRETE BATCH PLANT. THE PROJECT WOULD ALSO INCLUDE THE CONSTRUCTION AND OPERATION OF THAT SAND DRYER PLANT AND OPERATIONS BUILDING TRUCK SCALE AND OTHER ASSOCIATED EQUIPMENT, THREE STORAGE BUILDINGS FOR BULK SACK AND BAGGED PRODUCTS, A PRECAST SHOP, OFFICE AND BREAK ROOM, EMPLOYEE PARKING AREA, CONCRETE STORAGE AREAS, A CATCH BASIN ALIGNED RETENTION BASIN, AND THEN PERIMETER FENCING. THE PROJECT WOULD ADD UP TO SIX NEW EMPLOYEES TO THE FACILITY AND THEN ALSO INCUR 30 DAILY VEHICLE TRIPS, INCLUDING 18 TRUCK TRIPS. THE ORIGINAL PROJECT, WHICH WAS THE READY MIX CONCRETE BATCH PLANT, WAS APPROVED UNDER ADMINISTRATIVE APPLICATION NUMBER 08-033 AND THE PROJECT, IF APPROVED, WOULD OPERATE MONDAY THROUGH FRIDAY, 7:00 AM TO 5:00 PM.

THERE WOULD BE EXISTING. IT WOULD BE USING THE EXISTING FACILITIES AT THE ADJACENT FACILITY, INCLUDING WELLS, DRIVEWAY APPROACH AND SEPTIC SYSTEM. THIS SLIDE HERE SHOWS THAT THE PROJECT SITE IS LOCATED ON THE NORTHEAST SIDE OF INGOMAR GRADE, APPROXIMATELY 948FT EAST OF VOLTA ROAD IN THE VOLTA AREA.

AS YOU CAN SEE OUTLINED IN RED, THE PROJECT SITE CONSISTS OF THREE PARCELS AT THIS TIME.

THESE PARCELS WERE ORIGINALLY USED AS GRAZING LAND AND THEY ARE CURRENTLY VACANT AND FALLOW.

ALTHOUGH THE PROPERTY OWNER REGULARLY DUSTS THEM FOR WEED ABATEMENT AND FIRE CONTROL.

EAST OF THE VOLTA AREA, MOST OF THE USES ARE INDUSTRIAL, SO WE'VE GOT A JUNKYARD TO THE EAST OF THE PROJECT SITE, THE EXISTING CONCRETE READY MIX BATCH PLANT, AS WELL AS THE MORNING STAR PACKING COMPANY, AND THEN WE HAVE SOME RURAL RESIDENTIAL USES TOWARDS THE WEST OF VOLTA AREA.

THIS SLIDE HERE SHOWS THE CONCEPTUAL SITE PLAN FOR THE PROJECT.

THE PROJECT WILL BE BUILT IN A COUPLE OF PHASES THROUGHOUT 36 MONTHS.

PHASE ONE WILL BE IN SITE IMPROVEMENTS AND PHASE TWO WOULD BE THE STRUCTURES AND BUILDINGS.

THE PROJECT COULD BE FOUND CONSISTENT WITH OUR LAND USE GOALS AND POLICIES FOR THE RURAL CENTER, WHICH IS A VOLTA RURAL CENTER AS WELL AS THE INDUSTRIAL LAND USE DESIGNATION.

GOALS LU-4 AND POLICY LU 4.3 TALK ABOUT LIMITING ALLOWING LIMITED INDUSTRIAL LAND USES IN RURAL RESIDENTIAL CENTERS AS LONG AS EXCUSE ME. THEY DO NOT IMPACT AG.

AND WE HAVE DONE AN ENVIRONMENTAL STUDY AND SHOWN THAT THERE WOULD BE NO IMPACTS TO AGRICULTURAL LAND.

THE PROJECT WOULD BE CONSISTENT WITH APPLICABLE PROVISIONS OF OUR ZONING CODE, INCLUDING THOSE REQUIREMENTS FOR PARKING STANDARDS, LAND USE REQUIREMENTS, AND SO FORTH. AS I MENTIONED JUST A MOMENT AGO, THAT AN INITIAL STUDY AND MITIGATED NEGATIVE DECLARATION WAS PREPARED FOR THIS PROJECT.

AND FOLLOWING THE COMPLETION OF THAT STUDY, WE FOUND THAT MOST.

THERE WOULD BE NO IMPACT TO MOST AREA RESOURCES AND THERE WOULD BE LESS THAN SIGNIFICANT IMPACTS WITH MITIGATION FOR BIOLOGICAL RESOURCES AND CULTURAL RESOURCES.

FOLLOWING THE COMPLETION OF THIS STUDY, WE DID CIRCULATE A NOTICE OF INTENT AS WELL AS THE INITIAL STUDY AND MITIGATED NEGATIVE DECLARATION STARTING JANUARY 30TH FOR MORE THAN 30 DAYS ENDING ON MARCH 3, 2025. ONLY ONE COMMENT WAS RECEIVED FOR CALIFORNIA FISH AND WILDLIFE, AND THOSE WERE JUST ASKING FOR SOME ADDITIONAL MITIGATION REQUIREMENTS.

NO RECIRCULATION IS REQUIRED FOR THIS, SINCE THE INFORMATION THAT WAS REQUESTED AND PROVIDED AND REVISED IS CLARIFYING INFORMATION.

MITIGATION MEASURES THAT ARE EITHER STRICTER OR DO NOT AFFECT THE CONCLUSIONS OR ANALYSIS OF OUR STUDY.
