ONE OF THEIR THEY FORMED A GENERAL PLAN STEERING COMMITTEE THAT HAS CITIZENS AND COUNCIL MEMBERS ON IT. AND I'VE ATTENDED ONE MEETING TO DISCUSS LAFCO WITH THEM AND THE SPHERE OF INFLUENCE PROCESS AND THE PROCESS FOR FUTURE ANNEXATIONS AND THE RELATIONSHIP ON THE SPHERE OF INFLUENCE BETWEEN THE CITY AND THE COUNTY AND REACHED AN AGREEMENT ON THE SPHERE IF THEY CAN. SO THEY'RE IN THE EARLY STAGES RIGHT NOW TRYING TO DEFINE THE A STUDY AREA BOUNDARY THAT THAT WOULD BE USED TO EVALUATE THE FUTURE GROWTH AND EVENTUALLY EITHER ANNEX OR MAYBE THEY'LL THEY'LL HONE THE BOUNDARY BACK. BUT THAT'S THE STAGE THEY'RE AT. AND I'VE THEY HAVE BEEN KEEPING ME IN THE LOOP. SO HOPEFULLY THAT'LL, KEEP GOING AND WE'LL, WE'LL END UP WITH SOMETHING. WHEN IT COMES TO LAFCO THAT'S ACCEPTABLE. AND THEN AGAIN, THEY STILL HAVE TO MEET WITH THE COUNTY AND DISCUSS THE SPHERE AND NOT NECESSARILY REVENUE SHARING, BUT LAND USE RELATIONSHIPS. THERE WAS ALSO RECENTLY AN EMERGENCY OR EXCUSE ME, IT HASN'T HAPPENED YET, BUT THERE IS AN EMERGENCY WATER PROBLEM THAT A SMALL MOBILE HOME PARK THAT HAS 13 UNITS IN IT THAT'S OUT IN THE COUNTY ON THE WEST SIDE OF SCHAEFER ROAD, AND THEY'RE THE STATE'S BEST SOLUTION FOR IT IS TO HOOK UP TO CITY WATER. SO WE'LL BE GETTING AN OUT OF BOUNDARY EXTENSION APPLICATION. IT'S OUTSIDE THE SPHERE OF THE CITY, SO IT HAS TO BE BASED ON HEALTH AND SAFETY. BUT THERE'S STATE DIVISION OF DRINKING WATER IS INVOLVED. IT'S ALWAYS A HEALTH AND SAFETY PROBLEM. SO THAT'S THE NEXT APPLICATION THAT I'VE RECEIVED FROM THAT LETTER. YEAH, IT'S NORTH OF TOWN. YEAH, IT'S ACROSS SANTA FE TO THE NORTH. I'M KIND OF IN AN AREA THAT WINTON WAS LOOKING AT, BUT WINTON, THE WINTON WATER SANITARY DISTRICT, THINKING OF AN AREA FOR GROWTH, BUT THEY DON'T HAVE CAPACITY TO SERVE IT. SO AN ATWATER DOES. AND ONE OF THE ISSUES THAT I'VE HAD MEETINGS ON WITH THE POTENTIAL GROWTH IN THE MIDWAY AREA, WHICH IS ITS OWN SPECIAL DISTRICT AND IT'S ALSO A DISADVANTAGE UNINCORPORATED COMMUNITY, WE CALL THEM A DUCK AND UNDER SP 244, IF YOU ANNEX MORE THAN TEN ACRES, YOU HAVE TO LOOK AT BRINGING IN ANY ADJACENT DISADVANTAGED COMMUNITY. SO I THINK THAT THE CITY IS LOOKING AT BRINGING IN ALL OF MIDWAY AS PART OF THAT EFFORT. SO ABOUT SOUTH DOS PALOS YEAH, YEAH, IT'S TOO MUCH. [00:20:02] YEAH, MAYBE. YEAH. IT'S PEOPLE LIVING OUT THERE. SO THEY'LL THEY'LL THEIR VOTES WILL OUTWEIGH SOME LANDOWNER OR DEVELOPER ON WANTING TO ANNEX LAND FOR DEVELOPMENT. THERE'S ALL THESE OTHER OTHER PEOPLE INVOLVED. SO A LOT OF GOOD CITY, CITY AND NEIGHBOR RELATIONS THAT THAT WILL TAKE PLACE. SO THAT'S THAT'S GOOD LONG STANDING ISSUE. IT'S IT'S BEEN A LONG TIME COMING. OKAY SO OVER IN GUSTINE, YOU KNOW THEY HAD THEY HAD THEIR GENERAL PLAN UPDATE PROBABLY ABOUT EIGHT YEARS AGO NOW AND THEN WE HAD THAT LARGE SOUTHEAST ANNEXATION ABOUT THREE YEARS AGO NOW. UM, THEN LOS BANOS ADOPTED THEIR 2042 GENERAL PLAN EARLIER THIS YEAR, AND RIGHT NOW WE'RE TRYING TO SET UP A MEETING WITH STEVE MAXIE, WHICH IS THE COUNTY PLANNER AND MYSELF REPRESENTING LAFCO TO TALK TO THEIR COMMUNITY DEVELOPMENT DIRECTOR, STACY SOUZA ELMS ABOUT THEIR THEIR DESIRED SPHERE AND THAT IF THERE'S LAFCO ISSUES WITH THE SPHERE, WE SENT A LETTER TO THEM ON THE GENERAL PLAN AND THEN THE COUNTY HAS THIS THE SAME ISSUE WHERE WHEN YOU'RE WHEN A CITY WANTS TO UPDATE THEIR SPHERE, THEY HAVE TO GO NEGOTIATE WITH THE COUNTY. LAST TIME THEY COULDN'T REACH AN AGREEMENT WITH THE COUNTY AND THAT SPHERE NEVER GOT UPDATED AND THE MSR WAS NOT APPROVED BY LAFCO. ACTUALLY AT THE TIME IT WAS CONTINUED AND AND NEVER BROUGHT IT BACK. SO WE'RE DEALING, I THINK, WITH THE 2004 MUNICIPAL SERVICE REVIEW. SO RIGHT NOW ON TODAY'S AGENDA, WE APPROVED THE MSR UPDATE FOR THE RESOURCE CONSERVATION DISTRICTS. I HAVE A FULL PROPOSAL FOR THE LOS BANOS MSR UPDATE, AND I SENT THAT TO STACY SOUZA TO LOOK AT THE CONTENTS OF IT AND THE COST. AND THE CITY WOULD BE BECAUSE THEY'RE DOING AN UPDATE, THEY WOULD INITIATE IT, THEY WOULD BE REIMBURSING US FOR IT. IT'S IN THE NEIGHBORHOOD OF LIKE $46,000. AND SO, YEAH, SO WE'LL BE MEETING AND TALKING ABOUT THE PROCESS AND AND THE GENERAL PLAN AND SOME OF THE ISSUES. AND THEN THEY'LL BE TALKING TO THE COUNTY AT SOME POINT BEFORE TOO LONG IF THEY HAVEN'T ALREADY ON THE SPHERE ISSUES. THEY HAVE A CURRENT REVENUE SHARING AGREEMENT SO THEY CAN STILL ANNEX LAND ADJACENT TO THE CITY. AND WE STILL HAVE THIS PENDING AMG INDUSTRIAL ANNEXATION THAT THE CITY IS STILL WORKING, WORKING WITH THE APPLICANT AND I THINK CDD ON AT THIS POINT, BUT NO OTHER I HAVEN'T RECEIVED ANY OTHER APPLICATIONS FROM THEM OR ANY INDICATION OF NEW APPLICATIONS. AND THEN FOR MERCED, THE THE MAIN FOCUS OF MULTIPLE DISCUSSIONS HAS BEEN ON THE NORTH MERCED AREA AND ALL THE POTENTIAL ANNEXATIONS OF PEOPLE INTERESTED IN ANNEXING PARTLY BECAUSE OF UC MERCED AND BERKELEY, BECAUSE MOST OF THE GROWTH IS IS DIRECTED TO THE NORTH. SO THE AT THIS POINT THE. IMPETUS FOR THE ANNEXATION OF LAND NEAR THE CAMPUS THE UC MERCED CAMPUS HAS TO OCCUR AFTER THE CAMPUS ANNEXATIONS YOU CAN HAVE DISCUSSIONS, BUT YOU CAN'T. WE CAN'T PROCESS ANY ANNEXATION FOR ADJACENT LAND UNTIL THE CAMPUS IS ANNEXED. SO I UNDERSTAND THAT THE CITY AND THE UC HAVE GOTTEN CLOSE TO RESOLVING ALL THEIR ISSUES, OR MAYBE THEY HAVE, AND THAT ANNEXATION WILL PROBABLY BE DONE BY THE END OF THE YEAR OR SUBMITTED TO LAFCO BY THE END OF THE YEAR. SO WE'LL HAVE THAT TO DEAL WITH. AND THEN ONCE THE CAMPUS IS ANNEXED, LANDS TO CONTIGUOUS ADJACENT TO THE CAMPUS CAN BE ANNEXED. AND MR. COMMISSIONER BERTAO HAS A QUESTION. YEAH, I HAVE A QUESTION. THE CAMPUS EDUCATIONALLY IS, BUT IT'S NOT THERE'S NO ACTIVITY AROUND THE CAMPUS AND THE THE WHOLE SALES PITCH TO THE U.S. TO PICK MERCED, TO BUILD THE CAMPUS AND NOT GO TO FRESNO OR MADERA WAS THERE WAS AN INTEGRATED PLANNED COMMUNITY WITH IT THAT THE COUNTY, THE CITY OF MERCED AND THE UC THEMSELVES ALL JOINTLY PLANNED FOR. THERE WOULD HAVE BEEN DEVELOPMENT NOW AND IT WOULD HAVE BEEN IN THE COUNTY. AND THE ONLY REASON THAT THERE HASN'T BEEN DEVELOPMENT OUT THERE NOW, WHICH THERE SHOULD HAVE BEEN IT WAS PLANNED FOR, IS THAT THE CITY WOULDN'T GIVE SEWER TO THE COUNTY AND THE COUNTY DOESN'T DO SEWER. BUT NOW THROUGH THAT SPECIAL LEGISLATION WITH ADAM GRAY GOT PASSED, THE CITY CAN ANNEX THE U.S. AND GET AROUND, YOU KNOW, JUST ANNEXING BELLEVUE ROAD, BUT GET AROUND THE THE LEAPFROG TYPE ANNEXATION. BUT THE INTENT WAS ALWAYS THERE TO BE DEVELOPED AROUND THE CAMPUS. AND SO SO I THINK THE ARGUMENT IS MORE COULD THERE BE DEVELOPMENT IN THE COUNTY HAPPENING THAT MAY OR MAY NOT INVOLVE LAFCO BECAUSE IT WOULD JUST BE A COUNTY IF YOU DON'T FORM A SPECIAL DISTRICT OR SOMETHING, WHICH WOULD BE DIFFICULT BECAUSE THE COUNTY DOESN'T DO URBAN SERVICES, THAT YOU DON'T DO SEWER AND WATER. SO YOU'D PROBABLY HAVE TO FORM A SPECIAL DISTRICT. SO IT'S A UNIQUE SITUATION. I ACTUALLY TOOK THE LEGISLATION TO WHEN I WAS ON THE LEGISLATIVE COMMITTEE WITH CAL LAFCO. AND THEY THEY RECOGNIZED IT WAS USUALLY THEY WOULD SAY NO ON SOMETHING LIKE THIS, LIKE ALL THE AS YOU SAY, THE POLICIES FOR LAFCO DISCOURAGE THIS KIND OF THING. BUT THEY THEY TOOK A NEUTRAL STANCE AND SAID THERE'S UNIQUE SITUATIONS EVERY ONCE IN A WHILE AND BECAUSE OF THE ISOLATED CAMPUS IF THEY THOUGHT IF MERCED LAFCO IS WILLING TO APPROVE IT, WHICH YOU GET TO VOTE ON IT, IT'S THIS COMMISSION WHO WILL DECIDE IF IT CAN HAPPEN OR NOT. IF THEY FEEL IT'S IN THIS SITUATION BECAUSE OF THE PROTECTIONS IN IT, THEN THEN THEY WOULD STAY, STAY OUT OF THE PICTURE. NORMALLY THEY WOULD HAVE OPPOSED IT. AND SOME SOME PEOPLE VOICED OPINION THAT THEY SHOULD THEY SHOULD OPPOSE IT. BUT OVERALL, THE THE MAJORITY SAID OR THE VAST MAJORITY ACTUALLY SAID, LEAVE IT UP TO THE MERCED LAFCO TO DEAL WITH. SO SO IT'S VERY IT'S AN UNUSUAL SITUATION. AND YOU CAN IMAGINE A STUDENT OUT THERE OR THE FACULTY WANTS TO GET A STARBUCKS AND THEY GOT TO GO, WELL, THAT'S THEIR CHOICE. THREE MILES, YOU KNOW? WELL, YEAH, BUT I THINK IT HURTS THE RECRUITMENT OF STUDENTS. IT HURTS THE RECRUITMENT OF GOOD FACULTY TO HAVE THIS ISOLATED CAMPUS. SO IT COULD BE A BETTER IT COULD BE A BETTER FIT. AND HAVING, YOU KNOW, IT'D BE SO MANY YEARS BEFORE GROWTH NATURALLY WOULD GET OUT THERE THAT YOU DON'T HAVE ANYTHING FOR YEARS. ONE MORE COMMENT. IT'S SEVERAL YEARS AGO AND I ASKED THEM OR SAID ONE OF THEM SAID CITY REPS FROM THEIR PLANNING DEPARTMENT WAS DURING THE DROUGHT, NOT THIS LAST DROUGHT. THE DROUGHT BEFORE, YOU KNOW, I REMEMBER MAKING A COMMENT TO HER, YOU KNOW, I YOU HAVE TO ONLY WATER YOUR LAWN ONCE A DAY AND THIS PERSON DOES THIS AND YOU CONSERVE AND THAT CONSERVE. AND THERE'S SO MUCH DEMAND BY THE DEVELOPERS TO GET THEIR PROJECT IN THAT THERE'S MULTIPLE PROJECTS WITH THOUSANDS AND THOUSANDS OF UNITS. SO THERE'S SOME BY THE U.S., SOME OUT BY THE MERCED COUNTRY CLUB, SOME ON G STREET, THE NORTH SIDE OF BELLEVUE RANCH HASN'T EVEN BEEN BUILT. AND SO TALKING ABOUT WATER THERE IS PLANNING FOR I DON'T EVEN KNOW WHERE IT IS AND THEY'RE GOING TO BE ANNEXATIONS COMING. NEVER SAID, BUT IT COULD BE ENOUGH DEVELOPMENT.
